The East African Centre for Human Rights (also known as EACHRights) was established in May 2010 to undertake Human Rights work at a regional context. The organization is a non-partisan, Regional Non-Governmental Organization that seeks to initiate and conduct programmes that promote, protect, and enhance Economic, Social, and Cultural Rights (ECOSOC Rights) in Kenya, Uganda and Tanzania for vulnerable and marginalized groups. The organization employs the Rights-Based Approach in its interventions.
The Eastern Africa Child Rights Network (EACRN) was established in March 2014 to coordinate efforts by National Child Rights Coalitions in Eastern Africa in their advocating for children’s rights. EACRNs main objective is to accelerate progress in advocacy around child rights by national coalitions within a smaller context that will be fed into the processes of the Eastern Africa Regional Network. The network’s mandate is to implement programmes that focus on the realization of child rights as contained in the African Charter on the Rights and Welfare of the Child (ACRWC) and the United Nations Convention on the Rights of the Child (UNCRC). The advancement of the child rights agenda through the EACRN is achieved through engagement with governments, regional human rights bodies and other stakeholders working around children issues both nationally, regionally and internationally. The network seeks to accomplish this through capacity building of national coalitions and promoting information sharing among network members.
EACHRights and EACRN have fostered a good working relationship since 2014 by virtue of the fact that EACHRights hosts EACRN. The two entities have worked closely over the past six years towards the realization of their mandates during which time EACHRights has ensured that the EACRNs organizational objectives are achieved including providing support in setting up of their standards and operations befitting of a full-fledged institution. Further, EACHRights has ensured that all the donor obligations concerning regional child rights obligations are adhered to and measures put in place to hire competent staff responsible for the management and implementation of the local projects. Since 2014, EACHRights and EACRN have worked closely. However, 2018 presented challenges.
Consequently, this consultancy seeks to recruit a suitable person to mediate to restore the great working relationship that the two organizations have enjoyed for a long time. The mediator is expected to be a neutral third party well versed in civil society organizational leadership and with extensive experience working in the context of Eastern Africa. The mediator is further expected to work remotely in constant consultation between the Management Committee and the EACHRights leadership.
- A clear road map noting the issues canvassed during the mediation
- A report of the mediation exercise agreed on by both EACRN Management Committee and EACHRights’ Board
- A convening between the EACRM Management Committee, EACHRights, Save the Children and Plan International. The consultant is expected to present the findings of the report during this convening.
Duties and responsibilities of the mediator
· Maintain neutrality and impartiality towards all parties and ensure confidentiality of the process;
· Where required, assist in following up with the parties after mediation to receive feedback and to advise further services;
· Comply with all applicable ethical standards, processes, and procedures established by the parties
· Manage tasks assigned in a useful and timely manner
· Keep the SCI and Plan adequately informed of developments and matters requiring particular/immediate attention
· Provide reports, surveys, and feedback regarding the conducted mediations.
|· Professionalism: Has a thorough understanding of and significant experience in the mediation process. Demonstrates professional competence, is conscientious and efficient in meeting commitments, and observes deadlines.
· Communication: Speaks and writes clearly and effectively; listens to others, correctly interprets messages from others and responds appropriately; asks questions to clarify and exhibits interest in having two-way communication; tailors language, tone, style and format to match the audience; demonstrates openness in sharing information and keeping people informed.
· Judgement/Decision-making: Identifies the key issues in a complicated situation; gathers relevant information before making a decision; considers positive and negative impacts of decisions before making them; takes decisions with an eye to the effect on others and the organization; checks assumptions against facts; determines the actions proposed will satisfy the expressed and underlying needs for the decision.
Required skills and experience
The applicants shall meet the following criteria to qualify:
- A degree in law, conflict management or other relevant social sciences. A master’s degree in alternative dispute resolution (ADR) would be an asset.
- Formal training in conflict resolution.
- Proven mediation experience (at least five years); and
- Fluency in English (both oral and written).
The consultancy is expected to begin in October and finalized by December 2020.
